Attorneys attempting to bring a sale of real estate through the judicial process, for example through a foreclosure action, are required to file with the Clerk of Courts evidence of the property's title. Such evidence of title may take a variety of forms. Here at Hocking Valley Title Agency, Inc., we can conduct a title search on the property being foreclosed upon and prepare a preliminary judicial report , a final judicial report, or a judicial title commitment.

PRELIMINARY JUDICIAL REPORTS
Preliminary judicial reports are used in actions demanding the judicial sale of residential real estate consisting of one to four single-family units. Such reports set forth the legal description and street address of the property to be sold at the judicial sale, the property's tax identification number, the names of the record owners of the property, a reference to the volume and page by which the owners acquired title to the real estate, a description of the record title to the real estate except easements, restrictions, setback lines, declarations, conditions, covenants, reservations, and rights-of-way that were filed for record prior to the lien being foreclosed are not typically included, and the name and address of each lienholder having a record interest in the property.

FINAL JUDICIAL REPORTS
Final judicial reports are filed with the Court prior to submitting any order or judgment entry to a court that would order the sale of the residential real estate. The final judicial report shows the court that record title of the real estate has been updated from the effective date of the preliminary judicial report through the date the complaint was filed.

JUDICIAL COMMITMENTS
Judicial commitments are used in actions demanding the judicial sale of residential real estate consisting of more than four single-family units or of commercial real estate. A judicial commitment contains the legal description and street address of the property to be sold at the judicial sale, the property's tax identification number, the names of the record owners of the property, a reference to the volume and page by which the owners acquired title to the real estate, a description of the record title to the real estate except easements, restrictions, setback lines, declarations, conditions, covenants, reservations, and rights-of-way that were filed for record prior to the lien being foreclosed are not required to be included, and the name and address of each lienholder having a record interest in the property. The commitment will also include the amount of the successful bid at the judicial sale and will show the purchaser at the judicial sale as a proposed insured. If the purchaser pays the premium for the title insurance policy, it will obtain title insurance in accordance with the commitment.
